A lawsuit brought by Britons living in the EU27 against the bloc’s decision to open Brexit negotiations with London was ruled inadmissible by the EU General Court in Luxembourg on Monday.

Thirteen British citizens residing in EU countries asked the EU judges to annul the Council of the EU’s decision to starts talks with the U.K. government on the country’s withdrawal from the bloc.

They argued that the decision was illegal because they were denied a vote in Britain’s 2016 referendum, even though the outcome of the vote would deprive them of rights as EU citizens. Britons who had lived abroad for more than 15 years were barred from voting in the 2016 Brexit referendum.

The court said in a statement that it had dismissed the lawsuit as inadmissible because the Council’s decision “does not produce binding legal effects capable of affecting the interests of the applicants by bringing about a distinct change in their legal position.”
